A MAYOR protesting over the introduction of disc
parking deliberately got himself a parking fine in a bid to challenge the
legality of the system, a tribunal was told.

The chairman of the traffic tribunal in Leeds, Stephen Knapp, said he did not have the power to overturn the traffic regulation order (TRO), which introduced disc parking, meaning motorists would be unlikely to make retrospective claims against parking fines.
However, he did accept there was a logical argument that there may be problems with the TRO relating to Mr Hadlow’s 60 fine and adjourned his decision – saying he may travel to Yarm to view the arrangements for himself.
The tribunal heard Mr Hadlow received a fixed penalty notice on March 16 for parking in the High Street without a disc.
Yarm town councillor, Chris Johnson, speaking for Mr Hadlow, said the plan on which the TRO was based was not to scale, included nonexistent parking bays and contained massively inaccurate measurements.
He added that the fact that 3,500 parking tickets were annually issued in Yarm – more than three times higher than anywhere else in Stockton borough – demonstrated that motorists were confused by the disc parking because of inadequate signing.
He said: “It is very easy for a motorist to misunderstand the parking arrangements.
“Most tickets are issued to people from outside the town and most are for non-display of a disc.”
However, Jonathon Nertney, solicitor for Stockton Borough Council, which enforces the parking regulations, insisted that the Government order was legally constituted.
“We are not looking to people who did not understand, we are looking to Mr Hadlow,Bathroom floor tiles at Great Prices from Topps Tiles. who clearly did understand the arrangements and that is what we are examining today,” he added.
Mr Knapp said that he believed Mr Hadlow deliberately got himself a parking ticket but felt that there was a case that it may have been wrongly issued and would consider travelling to Yarm himself to examine the parking layout.
He said: “I will accept that there is a well-presented, logical and proportionate argument.”
A decison is due in the next ten days.
